General conditions (CG)
1 - Offer
The prices indicated in our offers and order confirmations are generally binding. However, we reserve the right to errors and technical changes. The above prices indicated refer to competitor prices, your own prices and/or the respective manufacturers' recommended reference retail prices. Any supply dates indicated represent non-binding information from our suppliers or manufacturers. We do our best to provide guidance to the best of our knowledge.
2 - Prices / Payment options
Our prices are gross, in Swiss francs, including value added tax (VAT). Purchased goods can be paid for in cash, via Maestro, PostFinance Card or by prepayment. Furthermore, the customer can pay without fees with credit cards (MasterCard, VISA or American Express) or Paypal
3 - Retention of title
The ownership of the goods remains ours until full payment of all amounts deriving from the purchase made (retention of title) and can be entered in the appropriate register.
4 - Returns and replacements
There is no general right relating to returns and replacements. The software is excluded from returns and replacements. Items can be exchanged within 14 days at any Amazing Games branch. Replacement is only possible if the goods and original packaging are intact, the packaging is not opened and the goods have not been used. In case of replacement, the original receipt must be presented. The replacement takes place at the price in force on the day of its processing or, at most, at the price paid by the customer. The balance of the goods is offset by credit. In any case, an amount of CHF 15 may be charged for the return/replacement.00. Any shipping costs incurred or other additional costs are non-refundable.
5 - Guarantee
Amazing Games Online only provides products that are new or in original brand quality. Used products or demonstration models are specifically indicated and marked accordingly. Amazing Games Online makes no warranty or liability as to whether certain products will fulfill their intended purpose or function in any computer system. Any customer complaints must be limited to the scope of the warranty offered by the manufacturer. No guarantee is offered for technical interventions and defects that can be traced back to improper use or external factors (humidity, liquids, impacts).
Unless otherwise specified, Amazing Games Online offers a warranty of at least 24 months from the date of purchase on all new devices. Batteries/accumulators, projector lamps, software, consumables and housing parts are excluded from the warranty. In the event of anomalies or defects for which there is no guarantee, the buyer bears the costs of searching for defects and associated costs. After this warranty period expires, the manufacturer's warranty period indicated on the invoice always applies for items with a longer warranty period. In this case, this means that Amazing Games Online forwards the item to the manufacturer on behalf of the customer for repair. The right of return or further claims are excluded in any case.
During the warranty period, Amazing Games Online reserves the right, in the case of items no longer available, to carry out a technically equivalent repair or replacement, or to recognize a credit for compensation of warranty rights. The amount of the credit depends on the value of the item in question.
The decision regarding whether to repair or replace a device rests with Amazing Games Online. The customer is not authorized to commission third parties for repairs. In this case, there is no right to a refund. Replaced or changed items do not give the right to any extension of the warranty. For any exchange of products, the binding warranty period remains the same starting from the date of initial purchase. In the event of faulty hard drives or other storage media, Amazing Games Online is not responsible for any loss of data. The customer is personally responsible for carrying out the backup.
The manufacturer may declare different warranty conditions, indicating them for example on the packaging of the item, depending on the country. These warranty conditions cannot be used and are therefore not to be considered valid. Any liability on the part of Amazing Games Online for direct or indirect damages, as well as loss of value in the event of defects or improper use, is excluded. In the case of software products, the customer is responsible for licensing compliance. Requests for intervention under warranty must be drawn up on the online customer account before sending the product (or also by telephone or e-mail with the exact indication of the quantity). Alternatively, you can also present it in person at an Amazing Games branch.
6 - Complaints
In case of technical problems, you must first read the instructions for use provided in written or electronic format. In any case, it is possible to contact customer service via Email: info@amazingames.ch. Per for returns, no return authorization number (RMA number) is required. Complaints must be made in writing within 5 days of the purchase date.
In case of defects within the warranty period, the customer must return the product with the original proof of purchase and a detailed description of the defect, immediately after having discovered it, by returning the product to the RMA department or by dropping it off at an Amazing Games branch . The product must reach Amazing Games Online in its original packaging or in careful packaging. Electronic products, such as CPUs, memories, graphics cards, hard disks, etc., they must be packed in an anti-static bag. Otherwise the warranty becomes void.
Basically the following items cannot be returned:
Products that were not purchased from Amazing Games Online
On-demand products (items that were ordered at the customer's request
Software and licenses
Open consumables (toners / filters, etc.)
Open products with hygienic implications (headphones, microphones, etc.)
The customer is required to back up his data before returning it. Amazing Games Online is not responsible either directly or indirectly for the loss of data and the material or immaterial damage resulting therefrom.
In the event that parts or individual formulations of these GTC do not correspond, no longer correspond, or do not correspond completely, to the legislation in force, the remaining parts of the GTC remain unchanged in their content and validity.
7 - Defects
The customer must check the goods to verify their completeness and must report obvious defects to the company immediately, or at the latest 5 days after receiving the goods. Otherwise, the delivery is considered accepted by the customer.
8 - Transfer of risk, transport and insurance
The company delivers exclusively to valid postal addresses within Switzerland, the Principality of Liechtenstein and Europe.
If the customer collects the goods at the company's premises, the risk of accidental loss or accidental damage is transferred to the customer when the goods pass. If the company ships the goods to the customer, the risk is transferred to the customer with the delivery of the goods to the customer via the carrier.
If the delivered products show material or manufacturing defects, including damage resulting from transport, the customer is required to lodge a complaint regarding such defects immediately after receipt, and at the latest within 5 days, against those made the delivery (Post Office, courier) and subsequently to the company. Furthermore, the customer is required to keep all packaging material until the case has been resolved.
9 - Products that have not been opened
Products that have not been opened can be returned within 14 days from the invoice date to obtain full credit for the value of the goods. The return/redelivery is the responsibility of the customer. The following products are excluded from this rule: notebooks, PCs (in particular those configured with the "PC configurator"), TVs, software, items ordered repeatedly, items excluded from return based on the indications relating to the items themselves, as well as those with a value greater than CHF 1000.
10 - Opened / used products
Products that have been opened, but in original packaging, without traces of use, can be returned within 14 days from the invoice date (postmark), for a surcharge equal to 20% of the value of the goods (excluding shipping costs). The return/redelivery is the responsibility of the customer. The following products are excluded from this rule: notebooks, PCs (in particular those configured with the “PC configurator”), TVs, software, items ordered repeatedly, items excluded from return based on the indications relating to the items themselves, as well as those with a value greater than CHF 1000.-, as well as items with hygiene implications (e.g. audio headphones, microphones, input devices, etc.)
Products with traces of use of any kind or products without the original packaging cannot be returned.
11 - Payment against invoice with installment payment option (POWERPAY)

MF Group / POWERPAY proposes to be an independent payment provider with the type of payment
"Paiement sur facture". The order facture allows you to easily adjust your order online by facture. If you reject a payment in the given details, you will be entitled to the right to return the next item to a monthly item with an opening of the order.
At the conclusion of the contract, POWERPAY takes charge of the creation of the bill and is responsible for the

Payment against invoice with installment payment option (POWERPAY)
MF Group/POWERPAY, as an external service provider, offers the payment method “against
invoice” . The order invoice allows you to easily pay for your online purchase against an invoice. If
you do not make a payment in the given time interval, in the following month you will subsequently receive
a monthly invoice with the summary of the order.
Upon signing the purchase contract, POWERPAY takes charge of the invoice credit generated and initiates the
corresponding payment methods. In case of purchase with invoice, in addition to our GTC, you accept the POWERPAY
GTC.

Purchase by invoice with partial payment option (POWERPAY)
As an external payment provider, MF Group/POWERPAY offers the payment option 'Pay by invoice'.
You can simply pay for your online purchase by invoice using the order invoice. If you do not make the
payment within the specified period, you will receive a subsequent monthly invoice the following
month with an order overview.
When a purchase agreement is made, POWERPAY takes on the amount receivable and processes it
using the payment method selected. By selecting purchase by invoice, you are also agreeing to our
GTC, POWERPAY’s GTC.

12 - Jurisdiction
All obligations are subject to Swiss law. Place of fulfillment and exclusive jurisdiction is Lugano.
