GENERAL TERMS AND CONDITIONS OF SALE – AMAZINGAMES

These General Terms and Conditions of Sale govern purchases of products from AMAZINGAMES, operated by Amazingroup SCL, Via Madonnetta 15, 6900 Lugano (TI), Switzerland, through the amazingames.ch online store and, where applicable, at the physical store.
Important: repair services are governed by the separate “Repair Service Terms and Conditions” and are not governed by these sales terms.
1 – Seller and scope

These terms apply to the sale of products to customers in Switzerland, Liechtenstein and European countries to which AMAZINGAMES makes delivery available through its online store.
Where the purchaser is a consumer, any mandatory consumer rights granted under the law applicable in the consumer's country of residence remain unaffected.
2 – Offers, products and conclusion of the contract
Product information, including images, descriptions, availability and delivery times, is provided with the greatest possible care.
Images are generally for illustrative purposes. Differences that do not affect the essential characteristics of a product do not necessarily constitute a defect.
By submitting an order, the customer makes an offer to purchase. The contract is concluded when the order is accepted by AMAZINGAMES.
AMAZINGAMES reserves the right to cancel an order in particular in the event of:
- subsequent unavailability of the product;
- an obvious pricing error;
- inability to obtain the product from a supplier;
- or another legitimate reason.
If an order that has already been paid for is cancelled, amounts paid for products that cannot be supplied will be refunded.
3 – Prices, taxes, customs duties and payments
The prices displayed in the online store at the time of the order apply, except in the event of an obvious error.
For deliveries to Switzerland and Liechtenstein, taxes are applied in accordance with the applicable regulations.
For international deliveries, VAT, customs duties, import charges or other fees may apply depending on the destination country and the information provided during the purchasing process.
Where these amounts are not collected directly by AMAZINGAMES at checkout, they may be charged to the recipient by the relevant authorities or carrier.
The available payment methods are those displayed during checkout.
4 – Availability, external warehouses and dropshipping
Some products may be stored in external warehouses or with suppliers and may therefore not be immediately available at our physical store in Lugano.
Where indicated on the product page, such items are primarily intended for online sale and may require additional procurement and delivery time.
An indication that a product is “available online” does not necessarily mean that it is immediately available at the Via Madonnetta 15 store.
Any stated timeframes are estimates unless a specific date has expressly been guaranteed.
The fact that a product is sourced from an external warehouse or supplied through dropshipping does not limit mandatory consumer rights.
5 – Pre-orders
Products identified as a “pre-order” may be purchased before they become available.
Release and delivery dates may depend on the manufacturer or distributor and may be subject to change.
If the distributor reduces the quantity allocated to AMAZINGAMES, the product becomes unavailable, or the pre-order cannot otherwise be fulfilled, AMAZINGAMES may cancel the order in whole or in part.
Any amounts already paid for products that cannot be supplied will be refunded.
A pre-order does not remove any mandatory consumer rights, including any statutory right of withdrawal where such a right applies.
6 – Delivery
AMAZINGAMES delivers to the destinations made available during checkout.
The customer is responsible for the accuracy and completeness of the delivery address provided.
Displayed delivery times are estimates unless AMAZINGAMES has expressly agreed to a binding delivery date.
For consumers in the European Union, mandatory provisions of applicable law concerning the delivery of goods also remain applicable.
7 – Transport and transfer of risk
For sales to consumers, the risk of loss or damage during transport passes to the customer at the time specified by the applicable law.
For consumers in the European Union, where mandatory EU rules apply and the carrier has been offered or appointed by the seller, the risk remains with the seller until the consumer, or a third party designated by the consumer, takes physical possession of the goods.
Customers are encouraged to inspect the parcel upon delivery and to report any visible damage promptly.
Failure to report visible damage immediately does not result in the loss of mandatory statutory consumer rights.
8 – Returns, withdrawal and refunds
Returns, rights of withdrawal and refunds are governed by the “Returns, Withdrawal and Refund Policy” published by AMAZINGAMES on its online store.
Switzerland and Liechtenstein
There is no general statutory right to cancel an online purchase simply because the customer has changed their mind. AMAZINGAMES nevertheless provides a voluntary return right subject to the conditions set out in its Returns, Withdrawal and Refund Policy.
European Union
Where mandatory EU distance-selling rules apply, consumers retain the statutory right of withdrawal provided by applicable law, generally within 14 days from the date on which the consumer takes physical possession of the goods.
Nothing in these terms limits any mandatory statutory right of a consumer.
9 – Sealed products, video games, software, TCG and collectibles
Switzerland and Liechtenstein
Under the voluntary return policy offered by AMAZINGAMES, sealed video games, software, TCG products and other collectibles may be excluded from change-of-mind returns after their seal or packaging has been opened, as specified in the Returns, Withdrawal and Refund Policy.
European Union
For consumers in the European Union, only the exceptions to the right of withdrawal provided for under applicable law apply.
Opening the packaging of a TCG product or collectible does not automatically remove a statutory EU right of withdrawal where applicable law does not provide for such an exception.
The consumer may, however, be responsible for any diminished value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.
10 – Pre-owned goods
AMAZINGAMES also sells pre-owned video games, consoles, accessories and other used goods.
The condition of the product and, where available, information regarding completeness, packaging, manuals, media, language, region and other characteristics are stated on the product page.
Normal signs of use or characteristics clearly disclosed before purchase do not in themselves constitute defects.
Pre-owned goods remain subject to any mandatory statutory guarantee rights under applicable law.
For consumers in Switzerland, any reduction of the warranty period for pre-owned goods is valid only within the limits permitted by law and where it has been validly agreed.
For consumers in the European Union, the statutory guarantee periods and conditions provided by applicable law remain applicable.
11 – Statutory guarantee and conformity
A change-of-mind withdrawal is separate from the statutory rights applicable to defective or non-conforming goods.
Switzerland
For consumer sales in Switzerland, the mandatory provisions of the Swiss Code of Obligations and any validly agreed warranty conditions apply.
European Union
For consumers in the European Union, statutory guarantees under applicable EU and national law apply.
For new goods, the legal protection provided by EU rules is generally at least two years from delivery.
Any commercial manufacturer's warranty is additional to mandatory statutory consumer rights and does not replace them.
AMAZINGAMES may request information, photographs or return of the product in order to verify a reported defect.
Where provided by applicable law, remedies available to the consumer may include:
- repair;
- replacement;
- a price reduction;
- or termination of the contract.
12 – Defective, incorrect or damaged products
Any problem should be reported to AMAZINGAMES at info@amazingames.ch, providing:
- the order number;
- the product concerned;
- a description of the problem;
- and, where useful, photographs of the product and packaging.
A request to report a problem promptly does not limit statutory guarantee periods or any other mandatory consumer rights.
Where an incorrect, defective or non-conforming product is attributable to AMAZINGAMES and covered by applicable law, necessary return costs will be handled in accordance with the applicable legal requirements.

Customers are encouraged to provide the order number and all information necessary to identify the issue.
The internal complaints procedure does not limit or replace any mandatory statutory rights or remedies.
14 – Liability
AMAZINGAMES is liable within the limits provided by applicable law.
AMAZINGAMES is not responsible for damage resulting from improper use of a product, use contrary to instructions, unauthorised modifications or the use of incompatible accessories, to the extent such limitations are permitted by law.
Nothing in these terms excludes or limits liability where such exclusion or limitation is not legally permitted in relation to a consumer.
For devices containing data, the customer is responsible for making appropriate backups before sending the device, subject to any mandatory liability imposed by law.
15 – Data protection
Processing of personal data is governed by the AMAZINGAMES Privacy Policy and applicable data-protection legislation.
16 – Severability
If any provision of these General Terms and Conditions of Sale is found to be void, invalid or unenforceable, the remaining provisions will remain effective to the extent permitted by law.
The invalid provision will, where possible, be replaced or interpreted in accordance with applicable law without affecting mandatory consumer rights.
17 – Applicable law and jurisdiction
To the extent permitted by law, the contractual relationship with Amazingroup SCL is governed by Swiss law.
For business customers and in other circumstances where a choice of jurisdiction is legally valid, the competent courts are those of Lugano, Switzerland.
For consumers, and in particular consumers residing in the European Union, the choice of Swiss law and Lugano jurisdiction does not deprive the consumer of mandatory protections or jurisdictional rights granted under the law applicable in the consumer's country of residence.
